True, you are right. but let me explain the patenting.
patenting programs would be like patenting a cooking book that only you can make cooking books and no one else, it's too broad and would be extremely expensive.

What is possible is copyright but when you publish your code copyright is already applied but only applies if you use that code if people code it differently you are nothing with your copyright.

It's also pretty unnecessary when there is already a bigger punishment for that than using someone's patented work.

Terms of Service, Copyright contract, and Computer Fraud and Abuse Act cover already enough ground to make sure this shouldn't happen.
