Sony/Playstation refusing refund decision because they are waiting for EA

EA completely avoided answering any questions, or addressing any issues outlined.

Absolutely useless.

Mod marked accepted solution themselves that does not solve or address anything.

All the issues remain, and EA has failed to even acknowledge the issues I'm facing with this game.

Under the Consumer Guarantee section of the Australian Consumer Law I am afforded a guarantee of quality for products purchased, and the right to a refund if these conditions are not met or cannot be resolved in a reasonable amount of time - I think 4 months more than qualifies in this case as EA/Dice have not even acknowledged many of these issues, let alone resolved them or even given an estimate.

I've requested a refund from Sony/Playstation on Jan 31 and they have not progressed my case as they stated they have raised these issues with the Publisher - this would be EA. Email screenshot attached.

Can you get your act together, confirm with Sony that your game is a faulty buggy mess so I can get my refund?

Here's the state of my game last I've attempted to play it:

- constant graphical issues, flashing, missing weapons/invisible players, sometimes game will start with majority of screen white and black lines preventing the match from being played as you can't see anything other than "noise" on the screen

- game starts and does not have any weapons to chose from referred to by many as the "empty loadout bug", shooting is the primary mechanic so this is a major fault

- game constantly loses customisation settings for weapons, vehicles, and specialists. These settings keep reverting to the defaults interfering with the ability to play the game

- constant glitched with map where friendly unit markers completely disappear, causing the inability to deploy on your squad mates, or where the actions is - this is compounded with the inability to communicate with your squad mates due to lack of in-game voice communication

- repeated game crashes in middle of game, get kicked back to the playstation menu with no ability to resume or rejoin game

- repeated "unable to load persistence data" errors for months when attempting to join game or start the application itself

- bullets inconsistently or do not register on target - this is the primary mechanic of the game

- melee actions not registering/trigerring

- unable to revive players at times, revive action not registering

- players clipping through walls, inside buildings, shooting from underneath the map

- vehicles climbing vertical surfaces - going up sides of buildings

- Game falsely advertised experience and weapon mastery as being able to be earned in all game modes - this is not true, no weapon unlocks in portal, limited progress in single player: "you’ll be levelling up and unlocking new weapons, gadgets, and cosmetics no matter which mode you’re playing" https://www.ea.com/en-au/games/battlefield/battlefield-2042/news/battlefield-briefing-get-ready-for-launch

- unable to join majority of games, with and without cross-play. Game advertised to have AI players so players can always find a game and play,

- paid for "year one pass" - still not getting the content 4 months later (Recently announced that this has been delayed to US Summer... That's June, July? 7-8 months after the game has launched)

- inability to play with friends on PS4 and Xbox One as advertised

- claim of "players will be given the services and evolution they have come to expect from modern multiplayer games, all aimed at keeping the community playing together for years to come." This is far from the truth - refer to twitter, reddit, ea help forums, valve and other game reviews

    If you would like to see if you're eligible for a refund of your purchase, you have to contact the retailer where you made the purchase. In this case, that seems to be Sony PlayStation. Unfortunately we can't assist with refund requests here via the forums in any way, even not if they have been made via Origin for example.

    Apologies for any possible inconvenience caused.

    If you would like to see if you're eligible for a refund of your purchase, you have to contact the retailer where you made the purchase. In this case, that seems to be Sony PlayStation. Unfortunately we can't assist with refund requests here via the forums in any way, even not if they have been made via Origin for example.

    Hi @EA_Leeuw ,

    As I mentioned in my original post, and as per the attached email screenshot, I ALREADY HAVE a case open with Sony for a refund, which is being held up by EA's lack of response to Sony.

    I'll summarise my original post in 2 questions:

    1: Why is EA not responding to Sony, in general and specifically regarding my case with Sony? This is holding up my refund decision for over a month now?

    2: Why is the game in such a shocking/buggy/unfinished state? When will these issues be resolved? Most of them haven't even been acknowledged by EA/Dice?

    You mentioned that you aren't able to assist with refund requests on the forum, that's fine but in that case please let me know how and where I can get assistance from EA/Dice? As a paying customer I have a right to, and demand support and a product of reasonable quality. You can't avoid your responsibility with the product by constantly referring me to other companies who do the same and avoid any ownership of the obvious issues.

    You can however answer the 2 questions above so I can have EA's official response to the matter (this is the official support EA/Dice/Battlefield forum, no?)

    @vw61aazxm0v if you are denied a refund due to the store policy that is it. The game is functional and can be played without issue.

    Tough unfortunately you don't seem to be familiar with Australian legal system and laws - which i explained and linked to in my original post which you seem to have not read.

    Australian Consumer Law part of the Competition and Consumer Act 2010 has a specific Customer Guarantees clause which legally guarantee customers right to repair or refund for products and services which are NOT ONLY fault, NOT ONLY of non-merchantable quality, but also with defects that "it has a problem that would have stopped someone from buying it if they’d known about it" - which if you refer to the list of bugs, issues and lack of promised content delivery is very true.

    I'm sorry if you are located in a country which does not respect consumer rights, but in Australia, where I am, this law applies, and so do these guarentees. What's happening in my case is... ILLEGAL, and Sony has previously been fined $3.2M for misrepresenting Australian consumer rights in the past: https://www.accc.gov.au/media-release/sony-to-pay-35-million-penalty-for-misrepresenting-playstation-gamers%E2%80%99-rights

    Too bad they have such a short memory...

    As you can see, I'm more than within my legal right to demand a quality product, that works as advertised that either has it's faults resolved in a reasonable time-frame (this has failed to happen), or get a refund (which is where I am now)

    Again, I value your opinions, but please if you are going to comment on matters regarding Australian right to refund, please familiarise yourself with the laws that apply here rather than blindly and incorrectly making statement that are factually incorrect. Looking forward to hear your thoughts once you've understood Australian Consumer Law

    @vw61aazxm0v you've bought a game and you dont like it. It happens. Just cause you're Australian doesn't make you special. The terms you agreed on in the psn store outline the refund policy. If that was unacceptable you should not buy from there.

    Did you miss the 16 unresolved issues and faults I listed in my first post?

    You obviously have not read a thing I posted since I need to keep repeating my points.

    The terms for ALL retailers, In Australia, where I am, where I purchased the product are; refund if faulty or of non-merchantable quality, as is mandated by Australian Law. Failure to abide by or misrepresent customer rights in Australia is illegal. I posted a link to the legislation but you seem to have just ignored it.

    While I understand your frustration, as mentioned earlier; unfortunately we can't help with refund requests here via the forums or in general with purchases that have been made on different platforms other than PC (Origin). I'm afraid that you have to reach out again to Sony PlayStation support for this.
