As a public official, it may be possible to use his likeness without his approval. (A whole slew of presidential likenesses have been on TV including SNL and of course Bush and Clinton in the Simpsons)
Although I would not expect Bush Sr. in the game. Morel likely a release of past presidents, but would have expected the release by now if they were going to do anything.
