Microsoft (NASDAQ:MSFT) is requiring Xbox One owners to waive their legal right to a class action against the company, according to a disclaimer on the company's website. Those who buy the company's upcoming video game console, the Xbox One, enter an agreement that any future legal proceeding against Microsoft is done on a case-by-case basis.
The Xbox One's pre-order disclaimer says Terms include binding arbitration with class action waiver to resolve disputes. That means that if the Xbox One has a widespread issue like its predecessor's red ring of death (RRoD), the affected owners will have to sue Microsoft individually, rather than banding together in a class action.
According to attorney Paul A. Herman, a consumer advocacy expert who has previously worked on class suits against large corporations, binding arbitration helps companies like Microsoft avoid large claims. Should a legal situation arise with the Xbox One, consumers have to hire their own lawyer and pay for legal costs up front.
So if they release faulty machines again, that is basically your problem.
What?
Seriously? That disclaimer is pretty standard and the rest is somebody's interjection trying to prove a point. This is getting silly, I wonder if the people who are speaking up against the XBOX One are actually tied somehow to Playstation. Not those posting here but those making these so-called reports.
People are going to buy what they are going to buy and arguing ad nauseam about it isn't going to change their minds.

Yeah, I read an article on this yesterday and just rolled my eyes. Arbitration is standard in agreements so this isn't news.

We all know how things on the internet are always true right?
How many of these "facts" about the Xbox one are actually legit and someone not spreading rumors to scare people away from the system. We will only know the specifics when the system is released. Microsoft is one of the word leading companies is console designs, im sure they love to make money, what people are purposing would scare away a large percentage of the potential buyers....seems all to fishy to me
Not to mention Sony has applied for similar pattens previously, yet no one seemed to get all bent out of shape. Saying they are only doing that if things get bad, they dont plan on incorporating it...lol. So many one sided fan boys for the PS4

This is a big deal because its Microsoft, notorious for a buggy product, to be honest it shouldn't matter as its common, but that isn't well known so people act shocked.
An the guy defending MS above me- everything Sony does they announced wasn't being used in the PS4, it's not blind fanboyism it's just being factual. And to be honest I agree with you too, Sony probably has something similar but I'm Almost 100% certain they don't on the Ps3

It's all based on Microsoft's unveiling of the system...their own word.
If it's all unfounded, then as a world leading company they are doing a * poor job of denying any of it. Every response from them has been to elaborate, but not deny the core concerns about used gaming, dedicated online system, lower specs, higher price, etc.
Yes microsoft is the one that released all the information on restrictions and so forth, so no need to wait till the systems are released. All the info out right now is correct.
You agree to the same thing for Sony when you update your PS3. Same thing on 360. It is a pretty standard practice. But hey, sensationalist headlines get page views, right?
Ever since the Supreme Court found that binding arbitration agreements that waive class actions for consumers is OK, these sorts of things have become pretty common. PS4/Playstation Network will have something similar.
IMO I'm ok with this because it protects them from paying out more then they should. If your Xbox blows up because something they did they should replace it. But when it's a class action suit with lots of people involved they tend to end up getting 20x the cost of the console. When really they should be happy getting it replaced for free since they wanted the product in the first place.

Well, let's not get carried away, here. That is not even a remotely accurate view of class actions.
A class action plaintiff in a consumer product suit would never get more than the value of the product because her damaged, by definition, cannot be more than that. And in most cases, they get a tiny fraction of the value of the product.

True. I got $10 for a Microsoft Office suit once. A fraction of what Office is worth. The ones who make the money off class action lawsuits are the lawyers.

It won't obviate warranty rights.
Settle down, kids.
