Seven years later - and after Isaac's death, the makers once again sampled his voice for the Stick Of Truth video game. Not sure why TSTO can't do the same, but like I said - depends on many factors.

Put it this way - they'd both be premium, EA can charge what they like and they're guaranteed sales. If Abe Lincoln and Space Aliens can make an appearance - so can "retired" lawyers and actors.
We'll probably never get to see any of Phil Hartman's characters in the game. I don't think they have been referenced within the show since his death. I hope I'm wrong though.

It's really sad, isn't it? I've watched a few documentaries on him, he was a great man. I love listening to the Simpsons audio commentaries where the writers / voice cast speak so fondly of him. I think it would be doing great justice to include Troy and Lionel in the game.

It is and him like Marcia Wallace may have been recurring cast members but they are still one of the most memorable ones

Oh, believe me, I know that situation well.
I would guess that the difference is that South Park Studios owned both Chef and those voice recordings. It's a much smaller studio (though under the oversight of a larger body) and Chef was not designed to look anything like Hayes, so there's no likeness rights to clear up. It was also a little different in that Isaac Hayes didn't die until a few years later.
And, South Park is in my top five favorite shows, but it's not as popular or as mainstream as the Simpsons. (Their licensing also tends to be pretty quick and dirty, if you ever listen to their commentaries about trying to get a song cleared in three days.)
