DirectX 12 not working with NVIDIA 4090 - DXGI_ERROR_ACCESS_DENIED

What happens when the bug occurs? I have just replaced my NVIDIA 3070 PC with a NVIDIA 4090 PC. When I try to launch Apex with the Direct X 12 command line setting "-eac_launcher_settings SettingsDX12.json" Apex text a long time to do anything (black screen with a small blue circle in the middle) and eventually a dialog pops up with DXGI_ERROR_DEVICE_REMOVED: 0x887A002B - DXGI_ERROR_ACCESS_DENIED (screen shot of full error message below). I have tried starting Apex with all Videa settings set to Low/Off as well as all settings on max. Apex works find with all setting set to max if I remove the DirectX 12 command line parameter.
What should be happening instead? Apex should load with DirectX 12 on a 4090 like it does on a 3070.
Steps: How can we find the bug ourselves? Try launching Apex with the DirectX 12 command line parameter on a PC with a 4090 graphics card.

Uninstalling the NVidia driver, rebooting and re-installing seems to fix the startup problem. I thought that it has fixed the jittering problem, but my Nvidia 4090 setup will not currently work on DirectX 12 wihtout lots of in game jittering so I am back to DirectX 11 which is using 50% more GPU power (up to 95%). Kinda defeats the purpose of a faster GPU.
