Until you actually pick a play to call, the game doesn't know what personnel to put on the field.  Your defensive personnel are still on the field, and thus, the last user controlled player gets called for the penalty.

@DanielsRyan82 Yes, that's my guess too. Anyways it is a weird result to call the penalty on a player who is definitely not causing the penalty.
