For the time being, the use of the image in the game is parallel to its use on television. That is, the image of Ralph in the game only resides on EA servers ... It is broadcast to us, but we have no access to it in the standalone sense. The use of broadcast rights would probably fall under the umbrella of the broadcast rights of the show. I'm not saying that there is no specific language concerning the game! Only that the theory his the same. That is supported by the very fact that I am only able to see Ralph in that costume when EA broadcasts it to me from their servers.
If at some point EA creates a standalone version in which I can have the game on my own device (offline), that would fall under the type of situation in which there are currently DVDs of the Simpson episodes in which Ralph appears in that outfit. Again, probably extra language, but same theory.
Now, if at some point TSTO releases coffee mugs or t-shirts with that image/outfit, that's a whole new ballgame! :)
