Patch 1.09 for BF3 on ps3 is failing

I bought Battlefield 3 for my playstation 3 ,3 days ago and I'm already unhappy. I bought it because I wanted to play online while I had to wait for my pc to get fixed...But now I can't. When I try and download the newest update for the game(1.09) it keeps giving me an error( something usually with 8002xxxx), usually at like 5 or10% but recently it goes up to about 70% and then gives me the same error. My other downloads haven't crashed as of yet and searching the internet hasn't helped.

I tried most of the things people said helped them, like clearing the game utility data, disabling media servers, disabling UPnP, trying different dns setting, god, I even tried installing it through proxy but it still gave me the error, some people say I just need to keep on trying and eventually it will be fixed magically..but that isn't working.

Please help, I know this is an common problem so there should be a solution, so please, share with me
