As far as I know it's impossible to unbind the ~ key as it is a default key for access to the console and this was made on the engine level. So, you can't do anything on your part.

They can add an option to disable it in the menus...would take like 5 minutes to code.
The number of times I've died because i accidentally hit the console button is ridiculous.
