As you have purchased from a retailer, the only way to obtain a refund is via the retailer, EB Games in your case.
So I brought it to them and they will not allow me to return the game. I also emailed them and this was their response:

As per our returns policy,
Returned product(s) must be in the original packaging and include any manuals, cabling and accessories in saleable condition. We reserve the right to limit returns to unopened or defective products. Defective product(s) will be replaced with a like item, upon return. Terms and conditions of manufacturer's warranty apply to defective video games systems and computer hardware after 30 days.
We do not accept returns of:
Any product(s) returned more than 30 days from the date on the packing slip
Any product(s) that has been opened (taken out of its plastic wrap)
Any product(s) not in its original condition
Any product(s) that is damaged, played, or is missing parts
Any product(s) that were sold as part of a bundle, unless the bundle is returned complete
Please do not send us product(s) that do not meet the return criteria listed above, as we do not issue refunds for non-qualifying items and cannot return the items to you.
We recommend you attempt to get a refund by going to one of our local stores. Please note that the store will not be able to give you full price if they accept to take it back. Because the game package has been opened, the store will not be able to sell it to another customer at full price value.
In addition, PC games that have one time use codes and once they are used, may no longer be used by another customer.

So i'm at an impasse., How can I get a refund, If both parties tell me to go to the other one for the refund??
- Anonymous8 years agoYour answer is in your post. You would have to take it to the retailer you bought it (ebgames). However since you played it... the game no longer meets their requirements since it has been opened/used or the code has been used. If it is a console version at that point all you can do is sell it to then as a used game. If it is a PC version with an activation code... enjoy your new game, cuz ur all done. It's all in the return policy that you posted. Sorry dude but I think you are out of luck at this point.

You have to use the activation code first to seee the game, you then find out that it does not work and you are screwed.Totally crooked that seems to be.Ea should offer you the refund out of good faith in my book, but it is a heartless company that is worth billions.I feel so sorry for you man really.
I have seen enough of ea and their trash games that dont work.I stepprd over to forza 3 so much nicer to play too than nfs, I ordered the crew yesterday as well, even though it is almost 4 years old the graphics are better looking than payback easilly, plus the world does not look dead and deserted like paybacks..
After payback Im done with nfs until they come up with a game is worth buying that actually works.I NEVER again will believe their flash trailers for games either cos they are full of lies.
