They were retired in the show yes. But that doesn't mean that those characters can't be brought out into other mediums.
Take into account those World of Springfield Action figures. They had figures of both Lionel Hutz & Troy McClure. Both characters had sound bites when they interacted with play sets & they were both released way after his death. Playmates had no problem whatsoever with Fox, Gracie Films or Phil Hartman's estate.
Surely EA & Fox can come to some kind of agreement on getting those characters in the game.
