Depends on many factors. After Isaac Hayes quit South Park, they were able to sample old clips for one final episode with Chef. Seven years later - and after Isaac's death, the makers once again sampled his voice for the Stick Of Truth video game. Not sure why TSTO can't do the same, but like I said - depends on many factors.

I would guess that the difference is that South Park Studios owned both Chef and those voice recordings. It's a much smaller studio (though under the oversight of a larger body) and Chef was not designed to look anything like Hayes, so there's no likeness rights to clear up. It was also a little different in that Isaac Hayes didn't die until a few years later.
And, South Park is in my top five favorite shows, but it's not as popular or as mainstream as the Simpsons. (Their licensing also tends to be pretty quick and dirty, if you ever listen to their commentaries about trying to get a song cleared in three days.)
