Ranked Races Penalties

Any chance you could make an attempt to fix the crap penalties. Another driver gets recovered to the track after an incident. I come along on the middle of the track, no contact and get an illegal overtake cos hes being recovered? Not the persons fault, not my fault - EA fault for poor gameplay - what should we do, stop on the circuit until hes recovered and moving?
