This got me curious so I booted my copy to double-check. You can access Build & Buy by pressing the Back button -- it should be the option that looks like a house with a hammer over it.

I'm stull not seeing it, exactly where is this button?
I was referring to the Back button on your controller, not something on screen.
When you press the Back button on your controller, an menu will appear with 6 labelled icons. From left to right they are:
- Live Mode -- a spinning green plumbob
- Town Map -- City Hall with a compass- Build & Buy -- a house with a hammer
- Landsculpting -- mountains with a lake and an upward pointing arrow
- Karma Powers -- a large sparkle surrounded by smaller sparkles
- Challenges & Rewards -- a trophy
