Wear and tear still happening despite being turned off

I had wear and tear off for a few games and suddenly it is back despite still being off in the menu. I'm getting it for all normal activities that would cause wear and tear despite it being off. Turning it on and off does nothing. Seems like the menu setting just works when it wants to. Very frustrating to see my RB with high health having tons of depleted stats a week after having 15 rush attempts.
