One of the many reasons is that official server providers don't monitor the servers of their customers as they are meant to. DICE will not shutdown someone's server before contacting the server provider.

The OP is regarding a Console server on PS3, not to mention claiming to have been banned by a server run by a Dice Employee, which if true and Ranked, would be in violation the TOS.  Who is the server provider for the PS3?
