Battlefield 3 FPS Locked at 43 (issue in 2022)

I recently bought EA play for steam and wanted to play BF 3 again now with better graphics at 60fps
but I was surprised that the game is permanently locked at 43 FPS something very strange indeed
I tried it on very low and the same thing happens, I deactivated everything but the game still only worked at 43 FPS and even lowered the resolution to the minimum and it still didn't go above 43 FPS.
look for info but there is nothing about it, only guides on how to improve performance in toasters but nothing for my problem.

Does anyone know why and how to fix this problem? I just want it to work at 60fps

-I do not have the FPS locked with any program.
-updated drivers
-No other game has this problem.
