I can see why you might think that, but when you open up the list of the possible battlepacks, you don't go through the animation of slamming the battlepack down, opening it, seeing the legendary colour, getting an XP booster then having the system go black for a few minutes and repeating the process to get a blue skin.

Have you heard of a resolution yet? I have actually had this same thing happened about 5 times but not with a rare skin. There were just the regular skins.
