Please can you provide us some of your system specification? I can give you some basic workaround, but it would help if we know a little bit more about your system.
You can try older or other states of your driver. Check for older driver builds (or Beta drivers), that might work.
If you are owner of a NVIDIA videocard, please download the latest physx driver. This could solve your problem. Some players reported that it even helped out with an ATI card.
Go to your custom settings of your video-card software. Disable all extra options for enhanced graphics and set the preferences for AA and anisotropic to “use application settings”.
Set the BF3 graphic options to “low quality” or reduce AA and anisotropic filtering to a minimum.
Launch the game, if the issue is solved, you can try to set the graphic options higher.
You can try to perform a clean boot.
Sometimes, this issue can be related to the cloud storage.
Open your Origin client, click on “Show Game Details”. Then you go to the cloud button on BF3 and uncheck the “enable cloud storage for all games” box. Launch the game.
If that helped, you can try to enable the cloud storage after a restart; it might work after with the cloud storage function. Make sure to use the local data when the information box popping up.
Please let us know if the issue still exist (and provide us your system specs), if it was solved by one of the workarounds, please accept as a solution.

Tried the clean boot and the Phyx driver and did not help
also ive only had this problem since a patch was released on 4/27

Im playing on an M17x-R2
i7 m620 @ 2.67ghz (dual core)
RAM (Memory): 8gb
Graphics Card: ATI Mobility Radeon HD 4870 (dual)

Okay i think we need to dig a littl bit deeper. What version of Windows you are using (and which service pack is installed)? Go in to you Raedon control software and try disable every special feature and set all preferences on "performance". Have you manually deleted your gamefiles in your "my documents" folder?
What are the other workarounds you already tried?

I am using windows 7 (service pack 1)
Everything was already set to performance on the Radeon controls.
I have uninstalled the game, deleted the registry (same goes for origin) and have also reinstalled everything. So far nothing has worked.
kernel error is not good, very root level fail.
try repairing the install, & always close & restart after an update. reboot may even be necessary
google for kernel errors or kernelbase.dll specifically & see if another board has any ideas.
