(Xbox 360) In-Game Issue - Spawning Without Weapon

Today when I played on my xbox360 I was being killed by my opponent when I spawned without any weapon in hand. I don't understand why I should spawn if my soldier has not loaded yet. Because it seems to be that way.
In the start of the game I almost always spawn without any weapon but after a while my soldier picks up my weapon, sometimes my enemies are able to finish "loading" in the start of the game and kills me before I even had the chance.

Okay, that's one thing but today I spawned in mid-time of the game on team deathmatch without a weapon, right in a war-zone and I got into a gunfight without having a weapon. I died. A player killed me after about 15 seconds having no weapon loaded on my soldier.

Another thing regarding this issue would be the similar problem that is keeping me from using new weapons. Even when I spawn in a game (team deathmatch) with my new weapon I have unlocked I don't have the ability to use the sight of my weapon, so I can't aim and kill my opponents (the sight is just a gray area). Because it takes like forever for the sight to load, so I die.
