The way the ToS is written, is that you are responsible for your account at all times.
So if someone did something while on your account and was banned, you are still responsible.

This is taken directly from the Terms of Service, section1. EA Account.

You are responsible for the activity on your EA Account. Your EA Account may be suspended or terminated if someone else uses it to engage in activity that violates this Agreement.
