Sorry to ask, but why do you think you need to patch?
As it was explained in this thread a couple of times, the versions available on the PSN and Xbox Lives are the latest available: you don't need to update manually and randomly a game on console. The publisher pays Sony or Microsoft and they deploy the patch on their network for every player to download it next time they log into the game. If you're interested check this Kotaku article about how much it costs to patch a game.
If you're just referring to the "A new update is available!" message that appears on the splash screen... it's just an ad that will probably never change now (Next message is "Mass Effect 3 Demo is here" for example...)
