The Geforce 9800 GT is now so very old that choosing usable nVIDIA drivers that will actually work with it isn't easy. More of their recent drivers don't work than do work, for a five year old graphics card. But your error message may, indeed, be related to omissions from Dx10 / Dx11. The game disk come with a version of Dx9 included that it wants to install, unless you make the mistake of vetoing that option.
