I can think of a few things that could be causing this... first off would be a bad drive (yes, it does happen, no, it isn't common) second would be that the xbox isn't brand new and is in fact refurbished (in other words you got ripped). I know it takes a long time, but try a factory reset on it to clear any settings that might be keeping you from downloading the game. Also, after that you might even want to see if there is a way to do a free space scrub on the xbox (I don't own one, but if this works you will want to do it in case someone had anything questionable on it before).
