I have been trying to play skate and it won't let me play because it keeps trying to send a code to a email thats not mine because some hacker swapped the email on my old ea account i have proof that the xbox account is mine please let me know if you guys can help

Sorry to hear someone else had gotten into your account and changed that email on you. If you haven't already, please be sure to go through as many of these security steps as possible to help get your account and system back into your control.
After that you'll need to get in touch with our support team to help recover the account itself. They'll be able to help update any account details as needed, though as they'll need to discuss private account details, that is not something we can assist with here on the forums.
