My personal idea would that they be available in the market but there would initially be a randomized 1 to 3 season resting period (they'd be present but unsignable) to simulate the retirement.
It's a shame the game doesn't have more of a contract system, because there could be the potential for having to try and tempt the driver out of retirement with contract terms.

Not really, they'd stay in the market but be greyed out and you could code a basic random 1 to 3 season timer, so when a season ticks over that would trigger the driver to become available again. Could allow other teams to sign them too, but there would be a good amount of time after they appear to allow you to sign them first. If you don't happen to be following them (I haven't played MyTeam for ages so I can't remember if there's a Shortlist feature, if not there should be) then it's a surprise when after 1 to 3 seasons, they suddenly come back with another team.
Or there could be a chance they could still never come back at all. They need to go deeper with this stuff, code in ages - the older the driver is, the more likely they're not going to come back if they retire. But sadly, I can't see that happening. The game is unfortunately pretty basic, just enough to scratch an itch and nothing more. It leaves you wanting more but can't provide it.
