need for speed the run, windows 10 install, DirectX error

windows 10 machine, has DirectX 12 and it seems the installer for Need for Speed, The Run is trying to install an older version. is there a way to have it NOT install DirectX as it is already the latest version?

Generally, your machine will tell you that a newer version is present.

You can see what happens by manually running the DirectX (newer or older) installer too.

here is what specifically happens,
try to install Need for Speed: The Run,
"DirectX Setup Error: An internal error occurred."
click ok,
"An unexpected error has occurred. Please try again in a few moments. Error: 327684:1
System:
Windows 10 64-bit
i5-4570 @ 3.2GHz
32 GB Ram
GTX 1660 w/6GB
DirectX 12

This is 100% repeatable as the exact same thing happens every time.
