Should this be considered illegal and/or an infringement?

Just saw a virtual-streamer* using an personal avatar that is obviously based on the classic zombie design in PVZ to stream and shooting video, and her channel (including streaming and video uploading) IS COMMERCIAL/MONETIZED (being able to make money for her).

I wonder whether that is an infringement by laws or copyright??

Picture 2 is a screenshot derived from the recording of her stream.

*virtual streamer: streamer that use an avatar and fictional character background to stream, instead of their actual identity.
