Xbox 360 - Plants vs Zombies - unable to download update and won't play

Xbox 360 - Plants vs Zombies - when trying to DL legends of lawn update xbox love says " you already have as many items as you are allowed to have try again later.
I'm trying to set up my sons new game as stated above.
It won't let him play unless he gets the legends of the lawn update, however, xbox live won't us download it and I am getting ready to bin the bloody thing ☹️
Any suggestions? Ample space in the storage device so that's not the issue.
I've tried google but couldn't find any similar threads.
Any help will be much appreciated.
