if I play on my parents account and I am under 13 could I get banned

So when I was 12 I wanted to play online so I made an account under my moms email so I could play and it would be like I am her but now that I need the requirements of ea I want to play on my account and I am curious could I get banned on this account or my Xbox even though it is a new account that meets all the requirements
