No this is way more than that. This is waiting specifically for 1 target and targeting only them. That's the malicious part.
It's an arena. Anyone can fight whomever they can target at any time they like. That's the design. There are no rules.
It's an arena where people have different payout hours so there is no positive reason for you to attack someone outside of your hour. You get nothing for it.
Apparently your opponent gets something - whatever it is.
Still:

CG should probably not put up with players like that if they can drive away customers..
Apparently your opponent spends crystals on refreshes to attack you. I'm not sure it would be better business to hinder him. However, that's irrelevant. There are no rules in arena - other than those that players themselves agree upon.
