The caveat here is that the AI will treat this as a heal and only do so if Palpatine is lower than.
Unclear if WAI or if these are bugs at this point.

What happens when Fives is on your team? Does he counter Palp?
No, so it shouldnt work for some toons and not others. Its a bug.
Counters are different. There are a variety of scenarios in which damage doesn't proc a counter, like assist attacks and stealth attacks. It's possible that they designed Palp's special to look like an assist to avoid counters.
