It's not discrimination. It's because the whole point of a legacy is to reach a 10th generation child who is directly related to the founder. An adopted child is not blood related to their parents. Therefore, it kinda defeats the whole purpose. The heir has to be blood related to their parents.
ETA: But remember, these are more guidelines than anything. The point of a challenge is to make the game interesting when you're bored. So play how you want to play.
