Default eyes being reported as CC by the Gallery

No mods, just default eyes and undies installed in my game. When I try to upload a sim to the Gallery it gets classified it as "modded" if I leave the default eyes file in my Mods/Packages folder. It ...

My issue is that it is not reporting all defaults as CC. I absolutely agree that they're CC but why only eyes and not undies?
