I have a "similiar" things. My best shot is that Sims aren't being rendered if you aren't viewing the upper floors.
Sometimes I notice that when my sims go downstairs sometimes i can't even see them coming down until they reach the lower level.
Game will only render things on and below the current level, so I'm assuming that since the sims are technically on the "higher" level, they are simply not being rendered in order to optimize the game performance.
I have a simular problem with the pools. The water in de the pool on the second floor looks clear from above but I can't see my Sims trough the windows, because the windows are not transparent.
I can't disable the laptopmode because then all my Sims look blurry.
The lastest patch didn't solve this problem for me.
I agree with JohnBigOz. It it likely that the OP is trying to view the sims from the level below so they are not rendering. Try being on the same floor as the swimming sims, then go into cameraman (tab) mode and lowering the camera. The sims *should* then be visible.
