If a fortress lasted to the 100th place it would still qualify!
I agree that some extra criterion should be used. I'm not sure about the ability to 'read' the level of the army within the system after the event, but if the badge wasn't gained with some extra criterion then it would be recorded I should think. New badges could also be a qualifying criterion. So the fact you killed a fortress in 2013 and none since would discount you. The definition of 'New' could start with a badge on a Tib/Wrath/Firestorm world or a WCS world and then work it's way to be within the last 2 years (as that seems to be when you're removed from a world, you shouldn't be able to use the badge for the newest WCS, although the badge should still be shown).
The likelihood of them changing this for WCS 2021/22/23 is very low in my estimation.
