Games with several software language packs like Battlefield 3 should work without any problem. Some older games were retailed only with one specific language pack, it might be the case that you have only the entitlements for the German C&C version. As a result, Origin can not download the English version of the game. You can try to download it and if you are only getting the German version you would need to get in contact with one of our Game Advisor. They would need to change the C&C language German entitlement to an English one.
