This ensures that people will pay more on FC points as EA rewards them for doing so. For rest of the players, they are of no use to EA so you get what you get.
You actually have to spend hundreds of dollars of real money, buy over 500 packs of THE MOST EXPENSIVE pack in the store and then you might have an actual REAL 5% chance of packing a TOTY player.

EA have developed a casino gambling game pretending to be a football game.
