FIFA ultimate team
Hi, I’m looking for some clarification regarding older FIFA games and community-run revival projects.
I’ve already read through EA’s Terms of Service and relevant policies, but I’m hoping to get a more specific answer from EA’s legal/IP perspective regarding FIFA, because FIFA is a somewhat unique situation due to EA’s previous licensing agreement with FIFA ending and the series continuing under the EA SPORTS FC name.
Some community projects are trying to restore online functionality for older FIFA titles where EA has officially shut down the original online services. This can include Ultimate Team, online seasons, matchmaking and other online features that are no longer supported by EA.
If a project is completely non-profit, doesn’t charge users, doesn’t distribute EA’s game files or copyrighted assets, and only provides replacement/community servers to allow players to use online functionality that EA has discontinued, could EA still request that the project be taken down?
I’d also like to know whether the situation differs between individual FIFA titles, such as FIFA 17, FIFA 18 and FIFA 19, particularly where EA has already shut down the official online services for those games.
Most importantly, does EA still retain the relevant rights over the older FIFA games themselves, including their game code, Ultimate Team systems, online infrastructure, branding and other game-specific IP, despite EA no longer holding the FIFA licensing partnership?
I understand the general EA Terms of Service may cover this, but I’m specifically looking for clarification from an EA legal/IP perspective on FIFA revival projects, rather than a general answer about EA games. I’m not asking for legal advice — I’d just appreciate knowing EA’s actual position on this specific situation.
