Mostly agree with the rest, but this one startles me a bit. Correct me if I am wrong, but the only thing that has been proven is that first selected prize in a race is (randomly) pre-determined, at least if the game has been saved to a cloud lately. Which is more of a necessity than anything illegal. Otherwise the save/race/load/race/load/... combo to get the prize one wants might generate too much traffic for the game to be playable by anyone.
I understand it is hard to prove anything more than that, and that we may assume it works the same way even without recent game save. But for me, this is somehow liberating, as I do not need to worry about which card to uncover, since I "know" it does not matter. Overall, the prize distribution is still random-like, and anything like the system choosing the prizes against the player in the long run are more or less based on cognitive bias.
No, it is quite simply illegal to represent something as a game of chance when it isn't. As EA will discover once the current regulatory investigation concludes. Whether you think it is ok or not, doesn't make it legal - doing it to prevent people from constantly reloading until they get the item they want - also doesn't make it legal. It is represented as a game of chance, it is not a game of chance and as such it is illegal - right there nothing else matters from a legal perspective.
