Seems very gracious of him to let you have first place and him settling for second. He could potentially step up his game and claim first, all hours of the day. You are suggesting he doesn't seem to have any problems going for second, all hours of the day, so probably first is also within his means.
He's not doing anything wrong. He is keeping his competition down somewhat, which is perfectly fine in a game. Sure it may be annoying to his opponents (all other players, and specifically the rest of you in your mafia) that are trying to collude against him. If he intends to play the game that way, your best option is probably forgetting that second place exists. You can jump from third to first.
Your other option is trying to beat him down, probably at an extensive crystal cost, and I personally don't think that's worth it.
