And it is not only against Executor, so I don't think it is a nerf to protect it, just a global bug. I tried my Malevolence against mostly Negos during my arena climb and the vultures never assist. Also I noticed an almost 100% dodge chance of the Spy special attack (need to check specifically about that tomorrow).
