1. You are only safe from being attacked while actively battling. So, during your "cool down" period, anyone can attack you and take your position. It's generally good practice to do you final battle at 53 minutes after the hour, which give you plenty of time to complete the fight, but gives very little time for someone to snipe you.
2. If the battle is still going at payout time, you get paid at the rank you were, not the rank you attain.
