Valid points all around, really. Thing is however that this game and games like it runs on server hand-shakes. Only way to get around people closing their apps to avoid TM preload would be near draconian restrictions, like mentioned by VonZant.
Really though, a preloaded enemy team can be both a boom and a curse. Going against JKR, preloaded TM can often be a good thing, as essential cooldowns will often be spent. Going up against a preloaded DR or NS squad however and it's not a good thing any more. In my guild, players are encouraged to force-close their apps if necessary, but it's by no means a requirement. Instead, we all try to choose our battles very carefully so as to maximize efficiency. It's the single best approach, and I can only remember 2 or possibly 3 TW losses out of countless.
