This is happening against slower cap ships, however even when you’re the same speed, a cap ship that is chosen to go first should always go first that’s RNG.
Negative, Ghostrider. When two or more ships/toons are at 100% TM, it's random which one will get to go first and each time it happens, even in the space of a single battle, there is a new random outcome.
