Does TFP really DODGE or rather RESIST? Because in case the target (TFP) is target locked, Bistan's ability should also inflict tenacity down.
The TM gain could be due to normal TM progression once Bistan's turn ends?
I am still farming Bistan's ship, so I can't really test it myself.

I'm not saying your bug report is unjustified, only trying to offer a potential explanation to make sure you checked that. Possibly, a video might help...

    It's most definitely a Dodge that flashes, and gives enemy capital ship TM.

    And Tenacity Down is unresistable at any rate. 😃
