I think the OP means is there an option to ask another sim to break up with their spouse, so that they can get married instead. I can't answer this myself because I've been waiting all day for the game to arrive (!!!!!!), but have you tried rotating to that household and manually splitting them up? From what I hear you can do this quite easily in TS4 and you won't lose anything in your current household. Unless of course he's a townie, then I don't know what to do :neutral_face:

Since it's a legacy challenge, I can't change households :( And I'm 99% sure he's a townie (not positive, though).

Yes, it can be done. It took a lot of courting on my Sim's part, though, because I guess the object of his affection had a really strong relationship with her spouse. Some time has passed and they've had their first child, but she sometimes still gets sad because of the divorce.

For mine and my hubby's simselves, I don't think it was incompatible traits. We both are family-oriented. I'm not too sure with my legacy girl. I don't see anything that would really stand out as incompatible, but I don't know all his traits yet. Of course, I'm not sure which traits would be considered incompatible at this point, so it very well could be.
