Players Charging Real Money for Gallery Builds

I recently found a beautiful stop motion build on YouTube, and was looking forward to downloading it from the gallery.  However, I read in the comments that the player has not yet uploaded the build ...

It is against ToS.

But they would need to find out who the account actually is, as most run it through a new account so if it gets banned it doesnt matter.

And then they are also not required to load up onto the gallery.
