@KimsSims if you download a sim from the gallery, add them to your game, make changes and want to save them, putting them in your library does not count as reuploading. As the library is private.
Were you may be running into a problem is how you're saving. I'm on my tablet right now so I cannot add a picture, but I'll try my best to explain. When you are in CAS, with either a sim you just created or one you downloaded, you have the option to save them. That's the folder looking button on the top. Or if it's a new game or family, the check mark on the bottom. Either way, when you click to save it opens up a box that shows your household. There you have too optionsf saving on the bottom. On the right, I think it's just a check mark, that saves them to your library only. On the left is the upload to gallery button. This both saves to library and to the gallery.
So if you choose that every time you go to save something, it's also going to the gallery, which is public. I think the reason Maxis is getting the "no stealing" thing too is because they favorite creations and they share those favorites through their account. Like when you go on the gallery and you see Maxis favorites, or top downloads. Don't see why people would get upset over that though, it's basically free advertising :neutral:

The little cloud upload button on the left is for the gallery, the folder button on the right is for library. I did this with a sim I randomized from the gallery to make sure.
Now, there are benefits to uploading to the gallery. If you have to switch computers, stuff in your library doesn't transfer (that I know of), but you can get things off your gallery. So I always upload my creations to gallery if I'd like to use them later. But I would be weary of uploading other people's creations, even if you made changes. You can always just download them again, and make changes.
